Rockville, Maryland Family Law Appeals Lawyers
If you received an unfavorable decision in your divorce, custody, child support or other family law case, or if you disagree with the Judge’s decision or are negatively impacted by the court’s decision, you may have a basis to file an appeal of the judgment and possibly reverse the court ruling or have it modified.
There is a narrow window within which to file an appeal, and if the deadline expires you may lose the right to appeal. Typically, a notice of appeal must be filed within 30 days after the date the court order is entered (but note some deadlines are much shorter).
Available options for a party to appeal a court order can include asking a court to reconsider the order based on new facts, requesting a new trial, filing to set aside the order, and filing a notice of appeal to the Court of Special Appeals. However, not all court judgments can be appealed. There are limited grounds to file an appeal. A few examples of an appeal being possible are procedural errors, a judge’s abuse of discretion, a failure to make adequate findings of fact, or misapplication of the law.
Family law appeals can be complex, time-consuming and costly, so it is important to be well-represented by experienced attorneys who have knowledge of the appellate process. If you wish to consider an appeal, please call us at (240) 386-8705 for a consultation. We can discuss your case and reasons for considering an appeal, the appellate process, and the legal options available to you.
